Notify the Insurance Company
The first step to the claim process is notifying the insurance company. This will help determine the potential resources that can provide compensation for the claim. In most cases, only the insurance companies of the parties involved in the accident will be involved. However, some cases may involve additional insurers as well. If the car accident is the result of a third party, such as the vehicle manufacturer, then the insurer of the third party would have to be notified. Assignment of Insurance Adjuster

A property damage claim such as those related to vehicle repair are handled separately from a bodily injury claim. You will have to make different claims for your personal injuries and property damage.
Demand Letter
At the start of the claim process, you may (with the help of your attorney) submit a demand letter to the other party or parties requesting compensation for afll the losses suffered because of the car accident.
Offer of Settlement
At the start, the insurance company may make an offer to quickly settle the claim. If the offer does not cover your basic expenses, do not accept the offer. In response to this offer, your attorney can make a counter offer. If the negotiations fail and the insurer fails to provide adequate compensation, the case would go to trial or enter the litigation phase. If your case goes to trial, a jury will decide as to what compensation you deserve and the decision will be binding on both parties.
